In a disheartening turn of events, the United States Congress has become a battleground over transgender rights even before history-making legislator Sarah McBride could be sworn in. McBride, who shattered barriers by becoming Delaware’s first openly transgender elected official, now faces discrimination from within the very institution she was chosen to help lead.
The controversy erupted when South Carolina Republican Representative Nancy Mace introduced a bill that would prohibit McBride from using the women’s restroom that corresponds with her gender identity. Mace’s proposed legislation has been decried by LGBTQ+ advocates as a blatant attack on McBride and an attempt to undermine the significance of her groundbreaking election.
Misgendering and Discriminatory Rhetoric
In a troubling display of intolerance, Rep. Mace misgendered McBride while discussing the bill with reporters. “Sarah McBride doesn’t get a say,” Mace stated bluntly. “I mean, this is a biological man.” She went on to assert that McBride “does not belong in women’s spaces, women’s bathrooms, locker rooms, changing rooms, period, full stop.”
Mace’s inflammatory rhetoric perpetuates dangerous misconceptions about transgender individuals and flies in the face of medical consensus. Major medical associations affirm that transgender people should be recognized and treated in accordance with their gender identity, not their sex assigned at birth.
McBride Responds with Dignity and Focus
In the wake of this discriminatory bill, McBride took to social media to address the situation with poise and determination. On X, formerly known as Twitter, she characterized the bathroom ban as a distraction from the real issues affecting Americans.
“Every day Americans go to work with people who have life journeys different than their own and engage with them respectfully,” McBride wrote. “I hope members of Congress can muster that same kindness.” She emphasized that her focus remains on “bringing down the cost of housing, health care, and child care, not manufacturing culture wars.”

McBride’s measured response highlights the misplaced priorities of those pushing discriminatory bathroom policies. At a time when American families are grappling with economic challenges and soaring costs of living, some Republican lawmakers appear more interested in stoking division and targeting marginalized communities.
Part of a Larger Anti-Transgender Agenda
Mace’s bathroom bill is hardly an isolated incident. It comes amidst a disturbing wave of Republican-led attacks on transgender rights across the country. According to data from the Human Rights Campaign, 14 states currently have laws on the books that restrict transgender individuals’ access to bathrooms aligning with their gender identity.
This coordinated assault on transgender equality was a cornerstone of former President Donald Trump’s re-election bid in 2024. His campaign funneled millions into ads disparaging transgender rights and stoking fear about inclusive policies. One particularly inflammatory ad, which cost the campaign a staggering $17 million, took aim at now-President Kamala Harris for her past support of gender-affirming healthcare.
Shifting Alliances and Opportunistic Politics
Rep. Nancy Mace, the bill’s sponsor, was once considered a moderate voice within the Republican Party. In 2021, she even backed the LGBTQ+ community by supporting the Fairness for All Act, which would have codified anti-discrimination protections for LGBTQ+ individuals in certain spheres of public life.
“I strongly support LGBTQ rights and equality,” Mace told the Washington Examiner at the time. “No one should be discriminated against.”

However, Mace’s ideological shift seems to have coincided with the redrawing of her congressional district. After South Carolina Republicans gerrymandered the district to be more safely conservative, Mace noticeably tacked to the right on social issues. The Supreme Court ultimately upheld this redistricting, despite a lower court finding that mapmakers had engaged in the “bleaching” of Mace’s district by surgically removing some 30,000 Black voters.
Mace’s bathroom bill, then, appears to be a calculated play to appeal to her redrawn district’s more conservative electorate. By making a splashy show of targeting McBride, she seems to be signaling her alignment with the Republican Party’s increasingly hostile stance on LGBTQ+ equality.
A Spotlight on Intolerance
Sadly, Mace is not alone in her crusade against McBride and the transgender community. Representative Marjorie Taylor Greene, a far-right firebrand known for trafficking in conspiracy theories and bigoted rhetoric, wasted no time piling on with a viral video where she repeatedly and deliberately misgendered McBride while voicing her support for Mace’s bill.
“Which is a man,” Greene declared when asked how one would verify the gender of individuals using women’s facilities. “He’s a man. He’s a biological male. So he is not allowed to use our women’s restrooms, our women’s gym, our locker rooms and spaces that are specified for women. He’s a biological male. He’s got plenty of places he can go.”

Greene’s cruel and dehumanizing characterization of McBride lays bare the depths of the animus and prejudice driving these discriminatory bathroom bills. It also underscores the difficult road ahead for transgender Americans and their allies in the fight for dignity, respect, and equal protection under the law.
A Call for Leadership and Equality
As McBride prepares to take her historic oath of office, she faces not only the weighty responsibilities of governance but also the specter of bigotry and intolerance within the very institution she aims to transform. Her unwavering commitment to focusing on the substantive issues impacting her constituents’ lives is a model of leadership that her Republican critics would do well to emulate.
Nevertheless, the fight for transgender equality and dignity remains an uphill battle. With Republicans weaponizing transphobia for political gain and an increasingly conservative judiciary poised to rollback hard-won protections, the path forward for LGBTQ+ Americans is perilous and uncertain.
Yet in the face of these challenges, there is hope to be found in the resilience, courage, and determination of trailblazers like Sarah McBride. By shattering barriers and refusing to be silenced or marginalized, she is lighting the way for a more just and equitable future – one where every American, regardless of their gender identity, can participate fully in the life of our democracy.
