Netanyahu, Gallant Face ICC Arrest Over Gaza War Crimes

In an unprecedented move, the International Criminal Court (ICC) has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and Hamas leader Mohammed Deif over alleged war crimes committed during the ongoing Israel-Gaza conflict. The dramatic development threatens to further escalate tensions in the region and complicate U.S. efforts to broker a ceasefire.

According to ICC Chief Prosecutor Karim Khan, there are reasonable grounds to believe Netanyahu and Gallant bear “criminal responsibility” for inflicting mass starvation on Gaza’s population, constituting both war crimes and crimes against humanity. The court also found evidence implicating Deif in atrocities including murder, torture, rape, and hostage-taking.

Netanyahu Defiant as Hamas Attacks Escalate

The arrest warrants come amidst a surge in violence after Hamas fighters killed over 1,200 Israelis, mostly civilians, in attacks on October 7th and abducted 250 others. Netanyahu has vowed not to compromise on Israeli control of strategic territory inside Gaza, accusing Hamas of negotiating in bad faith.

The Biden administration found itself in an awkward position, welcoming ICC warrants against Russian officials for Ukraine atrocities while denouncing the pursuit of Israeli leaders. This inconsistent stance drew sharp criticism from U.N. members, particularly in the developing world.

“The U.S. supports international justice and accountability, but rejects any attempts to target Israel unfairly,” a senior State Department official told reporters on condition of anonymity. “The warrants against Russian perpetrators are fully justified given the mountain of evidence of war crimes in Ukraine.”

Diplomatic Fallout and Ceasefire Hopes

While some nations have previously ignored ICC arrest warrants, the new indictments put Netanyahu and Gallant at risk if they travel to any of the 123 countries that are parties to the Rome Statute establishing the tribunal. This could curtail their diplomatic activities as the Gaza crisis deepens.

At the same time, analysts say the ICC move might paradoxically shore up Netanyahu’s domestic standing in the short term, as many Israelis reject the court’s jurisdiction over their country. The prime minister faces corruption charges at home and has seen his coalition weaken.
